Privacy Statement
The Newfoundland and Labrador Safety Council takes the privacy of
our members, customers and web site visitors very seriously. Our privacy
practices are guided by the model code defined in the Personal Information
Protection and Electronics Document Act (PIPEDA) defined by the Canadian

Accountability
The Newfoundland and Labrador Safety Council is responsible for
information under its control. As part of this accountability, the
Newfoundland and Labrador Safety Council has designated an individual who
is responsible for compliance with this policy and applicable legislation.

The Newfoundland and Labrador Safety Council is responsible for
personal information in its possession or custody, including information
that has been transferred to third parties for processing. When
transferring or sharing information with third parties we obtain written
assurance that the company is in compliance with PIPEDA and is aware and
abides by this policy.
Identifying Purposes
The Newfoundland and Labrador Safety Council will, in every situation
where personal information is collected, ensure that the client
understands why their personal information is being collected and how it
will be used.
The Newfoundland and Labrador Safety Council will maintain a record of
where the information is used and to whom it may have been disclosed.
Online Product Service Inquiry: Personal information
gathered via online web forms is limited to that required to effectively
respond to inquiries regarding our products and services. It is retained
only for the period of time required to respond appropriately to a
request.
Online Payment: Personal information gathered online for the
purposes of invoice payment by our customers is limited to a required
credit card and invoice data sufficient to process the payment. In the
case of credit card payments, the information provided is retained by
Moneris, the credit card service provider. Credit card numbers are not
viewable by Momentum IT Group, Inc. employees (our technology provider) or employees
of the Newfoundland and Labrador Safety Council.
Consent
The Newfoundland and Labrador Safety Council will obtain the informed
consent of an individual concerned about the collection, use, or
disclosure of that individual.s personal information, except as may be
required by law.
In most cases the reasons for use of the information are implied. If the
Newfoundland and Labrador Safety Council endeavors to use the information
for reasons that are not implied by the original collection, the Council
will obtain permission from the individual to use the information.
Limiting Collection
The NLSC collects only the information required to provide products and
services to our members and customers. If the personal information we
require is collected for a reason other than to provide products and
services, consent will be obtained before or at the time the information
is collected. The NLSC will collect personal information only by clear,
fair and lawful means.
Examples of why the Council collects personal information include:
- General communication with members and clients
- Processing membership applications
- Recording training records
- Processing and keeping track of transactions and reporting back to
members or clients
- Providing product and services requested by members or clients
- Recommending products and services that the NLSC believes will be of
interest and provide value to members or clients
- To comply with legal and governmental requirements
Limiting Use, Disclosure and Retention of Personal
Information
Personal information will not be used or disclosed for purposes other than
those for which it was collected, except with the consent of the
individual or as required by law. Personal information will be retained
only as long as necessary for the fulfillment of those purposes.
Accuracy
The Newfoundland and Labrador Safety Council keeps personal information up
to date, accurate and relevant for its intended use. Individuals may
request access to the personal information we have on record in order to
review and amend the information, as appropriate.
Safeguards
We take steps to safeguard personal information, regardless of the format
in which it is held, including:
- Physical security measures such as restricted access facilities and
locked filing cabinets
- Electronic security measures for computerized personal information
such as password protection, database encryption and personal
identification numbers
- Organizational processes such as limiting access to personal
information to a selected group of individuals
- Contractual obligations with third parties who need access to
personal information requiring them to protect and secure your personal
information.
Collection and Storage
The contact information that individuals submit is saved on a web server
that is maintained by Momentum IT Group, Inc.. This information is maintained and
secured for verification purposes.
The credit card information that individuals submit is sent directly to
Moneris and is not stored by Momentum IT Group, Inc. for any purpose.
Customer Files
Paper copies of customer files are not produced.
Online Security
We manage our server environment appropriately and our firewall
infrastructure is strictly adhered to. Our security practices are
reviewed on a regular basis and we routinely employ current technologies
to ensure that the confidentiality and privacy of personal information is
not compromised.
This website uses Secure Socket Layer (SSL) and 128 bit encryption
technologies to enhance security when individuals visit the secured areas
of these sites. SSL is the industry standard tool for protecting and
maintaining the security of message transmissions over the Internet. When
an individual accesses their accounts or send information from secured
sites, encryption will scramble the data into an unreadable format to
inhibit unauthorized access by others.
Openness
The Safety Council is committed to providing understandable and easily
available information about our policy and practices related to management
of personal information. This policy is available at all times on our web

Individual Access
Upon request an individual shall be informed of the existence, use, and
disclosure of his or her personal information and shall be given access to
that information. Individuals shall be able to challenge the accuracy and
completeness of the information and have it amended as appropriate.
Challenging Compliance
Any concerns related to our client personal information handling practices

Any individual making a request or challenging the accuracy of any
personal information will be required to provide sufficient personal
identification to the Council as required by Council staff.
All challenges to the accuracy or handling of personal information must be
in writing. Our privacy officer and/or appointed office personnel will
fully investigate the validity of any challenge to accuracy, collect or
use of information. The result of the investigation will be subsequently
communicated to the complainant in writing.
The NLSC will maintain a record of all requests, subsequent correspondence
and actions taken as result of the challenge.
